Rental Agreement

By submitting this form, you acknowledge that you have read, understood, and agreed to the following rental agreement.

Safety, Policies, and Conditions

Space Requirements & Electrical

Please specify that the surface area the Bounce House will be on is flat and the type of surface as well such as grass, concrete or indoor.

We recommend separate grounded outlets on dedicated 20 AMP circuits to power each blower that inflates the attraction. Most retractions only require one blower which runs continuously while the inflatable is in use.

Also, please be sure to specify the distance between the plug outlet to the Bounce House and whether or not the venue will need a generator.

Additional fees will apply for use of generator.

Deliveries & Weather

A $25 delivery fee may apply for distances greater than 15 miles.

We reserve the right to arrive two hours prior to the rental setup time, and request up to two hours after the rental end time.

As the customer you have up until the time we arrive at your party location to cancel due to weather conditions. Upon cancellation you will forfeit your non-refundable deposit. Once the attraction has been delivered and set up there are no refunds due to weather.

Misuse & Damage

There should ALWAYS be an adult in direct supervision of the Inflatables at all times. The most important duties of an attendant are limiting the number of children in or on the Inflatable at one time, making sure that the children are all of similar size and controlling the behavior of all Participants. If you need someone to stay with the unit to supervise the kids, we can provide an attendant for a reasonable fee. To ensure the best experience for everyone, no food is permitted inside of the bounce houses. If any repair or replacement of our machines/equipment is necessary due to customer damage or abuse then the customer will be held financially responsible.

Terms & Conditions

Lessor hereby leases and Lessee hereby takes from the Lessor the personal property listed under ‘Description’ (herein called the ‘rented property’), subject to the following terms and conditions.

CUSTOMER RESPONSIBILITIES

Customer is responsible for correct measurements and placement of rented equipment. No refunds are given for improper measurement or placements. We recommend an adult be available at time of delivery to insure proper placement of equipment. If your event takes place at a park, a marina, etc., it is your responsibility to obtain the permit and assume all charges for entry and exit. Since we are on a schedule for our deliveries, if nobody is available for delivery, we cannot wait and we will leave to the next job. If we need to re-deliver due to customer’s lack of responsibility or not being present for delivery, there will be an additional fee of $35.00.

INSPECTION

The lessee acknowledges that he/she has personally inspected the equipment, find it suitable for his/her needs and in good condition, that he/she understands its proper use and agrees to inspect the equipment prior to use and notify the lessor of any defects. The lessee acknowledges that he/she has personally counted the equipment and agrees that the quantity delivered is in the amount of the contract.

REPLACEMENT OF MALFUNCTIONING EQUIPMENT

If the equipment becomes unsafe or in disrepair, lessee agrees to discontinue use and notify the lessor who will replace the equipment with similar equipment in good working order, if available. The lessor is not responsible for any incident or consequential damages caused by delays or otherwise.

Warranties

There are no warranties of merchantability of fitness either expressed or implied. There is no warranty that the equipment is suited for the lessees intended use or that it is free from defects.

Hold Harmless Agreement

The lessee agrees to assume the risks of and hold the lessor harmless for the property damage and personal injuries caused by the equipment and/or arising out of the lessor’s negligence. The lessee shall indemnify and hold the lessor harmless from any claims of third parties for loss, injury, and damage to their persons and property arising out of the lessee’s possession, use maintenance or return of equipment.

PROHIBITED USES

Use of equipment in the following circumstances is prohibited and constitutes a breach of contract: a.) Use for an illegal purpose or in illegal manner, b.) Improper unintended use, or misuse, c.) Use by anyone other than the lessee, without the lessor’s written permission, d.) Use at any location other than the address furnished by the lessee without the lessor’s written permission.

DELIVERY

Deliveries with special conditions are subject to additional charges, this includes but not limited to special delivery time or day requests.

TIME OF RETURN

The lessee’s right to possession terminates on expiration of rental period and retention of possession after this time constitutes a material breach of this contract and any extension must be mutually agreed upon in writing. The lessee also agrees to return and/or prepare the equipment for removal in the same manner in which it was delivered. No refunds will be given for unused items such as syrups, popcorn, etc.

DAMAGED/LOST EQUIPMENT

The lessee agrees to pay for any damage to, or loss of equipment as an insurer, regardless of cause, except reasonable wear and tear while equipment is out of the possession of the lessor. Accrued rental charges cannot be applied against the purchase or cost of repair of damages or lost equipment. Equipment damage beyond repair will be paid for at its replacement cost when rented.

THEFT OF EQUIPMENT

The lessee agrees to pay (at its replacement cost when rented) for all types of theft or mysterious disappearance. Damage waiver does not cover theft.

FIRE & FIREWORKS

Lessee agrees to keep all equipment away from fire (i.e., fire pits/grills/cooking equipment) and fireworks. Any damage resulting from neglect of this clause will be charged for equipment repair charges and/or equipment replacement costs.

COLLECTION COSTS

The lessee agrees to pay all reasonable collection, attorney’s fees, court fees, and other expenses involved in the collection of the charges or enforcement of the lessor’s rights under this contract.

WAIVER OF JURY TRIAL

Lessee hereby knowingly and voluntarily waives any right lessee may have had to a trial by jury in respect of any litigation based on this contract.

REPOSSESSION

Upon failure to pay rent or other breach of this contract, the lessor may terminate this contract and take possession of, and remove equipment from wherever it is, and the lessor and agents shall not be liable for any claims for damage or trespass arising out of the removal of equipment.

DISCLAIMER OF MANUFACTURE

The lessee agrees that the lessor is neither the manufacturer of the equipment nor the agent of the manufacture.

LOADING AND UNLOADING THE EQUIPMENT

If the lessor’s employees load or unload the equipment, the lessee agrees to assume the risk of and hold the lessors harmless for any property damage or personal injuries to the lessee.

UNRETURNED EQUIPMENT

That the lessor may report as stolen all personal property not returned and the end of the rental period of if conditions and circumstances indicate theft before that time.

UNDERGROUND UTILITIES/SPRINKLER SYSTEMS

The lessor is not responsible for underground utilities or any other below grade damage when staking equipment. It is the lessee’s responsibility to identify all underground lines and/or cables.

INCLEMENT WEATHER

Lessor reserves the right to remove any and all of its rental equipment, at any time, from the lessee’s possession due to inclement weather and or unsafe conditions, or regardless of cause.

CANCELLATIONS

Cancellations must be made 7 days prior to the scheduled event to receive a deposit refund. All orders cancelled within the 7 days of the event will forfeit the entire deposit. Any item(s) cancelled within 48 hours of delivery will result in a fee of 20% of the cost of the cancelled item(s).

REDUCTIONS OR ALTERATIONS

And reductions or alterations of this contract are subject to cancellation at the discretion of Purple Heart Party Kids, LLC.

ANY RETURNED CHECK FEES

The lessee agrees to pay a $30.00 fee for returned checks.

LIABILITY WAIVER

I voluntarily release, indemnify, and hold harmless and discharge Purple Heart Party Kids, LLC and its employees, owners, officer and agents, from any and all liability, claims, demands, actions or rights of actions, whether personal to me or to a third party which are related to arise out of, or are in any way connected with my rental of the unit including those allegedly attributable to negligent acts or omissions. I agree to reimburse any reasonable attorney’s fees and costs that may be incurred by Purple Heart Party Kids, LLC in the defense of any such liability claim, demand, or action. Lessor cannot under any circumstances be held liable for injuries as a result of acts of God, nature, misuse of equipment or other conditions beyond its control or knowledge.

RULES

Lessee agrees to supervise both the equipment and its use at all times said equipment is in the possession of the lessee. Accompanying this contract is a set of directions for use and safety rules that I agree to follow and utilize at the time during the operation and use of all rented equipment.

FEES

The lessee shall be held responsible for vandalism and theft while the equipment rented is in their possession. The lessee agrees that the inflatable will not be subjected to unnecessary rough or destructive use. If the inflatable is returned in a damaged condition, the lessee shall be liable for the estimated cost of such repairs or replacement. The lessee agrees to an automatic $50 clean up fee if the inflatables are returned with any prohibited items found in the inflatable, including but not limited to candy, syrup, etc.

This agreement is the entire agreement between the lessor and lessee, and supersedes any other communications or advertising with respect of products and documentation. The laws of the State of Michigan shall govern this agreement.

Inflatable Safety Policy

The maximum number of children allowed on an inflatable is as follows:

2 - 8 years{dots}8 Children

9 - 13 years{dots}6 Children

14 - 17 years{dots}4 Children

18+ years{dots}2 Children

Please allow only compatible age groups to play on the inflatable at the one time. Children must be supervised by an adult at all times.

Rules must be explained to children prior to use.

Rules

Persons not following safety rules should be excused from play immediately.

  1. Always operate under adult supervision. Inflatables must be in viewing range AT ALL TIMES.

  2. Individuals with head, neck, back or other muscular-skeletal injuries or disabilities, pregnant women, small infants and others who may be susceptible to injury from falls, bumps or bouncing are NOT PERMITTED in the unit at any time.

  3. EXTRA CAUTION and supervision is required when younger children are on the inflatable.

  4. Ensure all participants are in groups of similar size whenever possible. It is recommended that older children should be warned that they can send the smaller ones flying if they bounce too close or could cause an injury if they come in contact or fall on them.

  5. ABSOLUTELY NO flips, wrestling, or other forms of roughhousing or extreme horseplay are allowed in the equipment.

  6. DO NOT allow participants to Bounce, Sit or Lay down near the doorway unless entering or exiting the bounder.

  7. Do not bounce any closer than two feet from each other or within two feet from the door. Bouncers should not sit or lay down while others are bounding around them, as a jumping child could fall down on top of a sitting or lying child.

  8. Do not dive or jump through the entrance or exit of the equipment. Our inflatables are equipped with a safety entrance. Bouncer must enter and exit the inflatables from a sitting or crawling position.

  9. Do not allow running in and/or bouncing against the sides of the inflatable equipment.

  10. Remove all shoes, eyeglasses and sharp or pinned jewelry. Dangling and hoop earrings are the leading cause of injury. Have shoes clearly placed well out of the way of the entrance.

  11. No PETS, sharp objects, or hard toys allowed inside the bouncer.

  12. Stay off netting at all times. Do not allow climbing or hanging from the interior or exterior of the equipment.

  13. ABSOLUTELY NO FOOD, BEVERAGE, OR GUM is allowed in or on any inflatable equipment.

  14. No ‘Silly String’ allowed in or around inflatable equipment. Should Silly String come in contact with the equipment, it will cause irreparable damage and damage fees will be incurred.

  15. In case of high winds (over 20mph) and/or lighting, have children exit equipment and unplug blower o deflate unit.

  16. In case of accidental deflation have children exit equipment then check for power outage or intake blockage to blower unit or disconnection of the blower tubes. (See set up requirements below).

  17. Do not allow use of the equipment if the surface becomes wet. Have the inflatable surface towel dried before resuming play.

SET UP REQUIREMENTS

Before the inflatable arrives, please turn off automatic sprinklers and do not water the grass the night before. Pick up all animal feces. Make sure the area is level and free of rocks, sticks, etc. Also, please do not water grass until inflatable is picked up.

The inflatable can be set up on grass (preferably), cement, asphalt, or other surface that is relatively flat. The unit must be setup within 100 feet of an electrical outlet. Extension cords cannot be doubled up and no items can be connected to that some outlet.The inflatable will be inflated before it is removed so that we can inspect and do a preliminary cleaning of the unit.

WEATHER POLICY

Our inflatables have a roof, which provides shade from sun and light rain. However, if the local weather is call for all day rain/storms or winds of 20 mph or more on your reserved day and both you and Purple Heart Party Kids, LLC agree before delivery that it may be unsafe to use, then we will cancel the rental without penalty.

PLEASE NOTE: NO REFUNDS WILL BE GIVEN AFTER THE INFLATABLE IS SET UP.

If the inflatable unit gets wet, everyone should exit the inflatable and unplug the blower unit. If the inside of the inflatable becomes wet it can become very slippery and can become dangerous. If the inside does become wet, dry with towels. Once dry, the inflatable should be once again safe for use.
